Dear Members,
On behalf of the Board and the Steering Committee, I would like to thank all members who participated in the recent vote on the Special Resolution concerning the 9.144m setback rule and proposed exemptions.
I am pleased to report that the resolution has been adopted, with 79.47% of votes cast in favour. For probity and transparency, all votes were collated by the Returning Officer, and the count was overseen by a member of the Steering Committee.
In line with this overwhelming approval, the new 9.144m setback exemptions now include:
Properties with insufficient depth (as defined on SWL plans);
Lightweight structures open on at least three sides so as not to obstruct neighbours’ views and are complying development or have DA approval;
Existing structures built on or before 31 December 1999 without modification; and
Council-approved structures that have both development consent and SWL exemption.
The adoption of this resolution reflects the community’s shared commitment to protecting property values, maintaining the aesthetic and structural integrity of our waterfront, and ensuring a consistent and fair approach to managing waterfront development. With that in mind, in accordance with these new setback rules, the Company will now enforce the setback provisions for those that continue to be non-compliant with the above exemptions. That is, enforcement actions will take effect immediately only in respect of developments and/or structures that are located within the 9.144m setback and do not meet any of the approved exemptions.
A sincere thank you to the members of the Steering Committee who assisted over the past six months in developing and refining this proposal, engaging with the community, and supporting the consultation process that has led to this successful outcome.
